Welcome to Kaizen Dojo. These Terms of Service ("Terms") govern your access to and use of the website kaizenmensweekend.com and all related websites, services, events, and programs operated by Kaizen Community, a nonprofit limited liability company doing business as Kaizen Dojo ("we," "us," or "our"). By accessing our website, registering for an event, or using any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Eligibility
Our events and services are intended for adults aged 18 and older unless otherwise specified. Certain programs, such as the Young Men's Weekend, are designed for participants aged 13 to 20 and require parental or guardian consent for registration and participation. By using our services, you represent that you meet the applicable age requirements and, if registering a minor, that you are the parent or legal guardian authorized to consent on their behalf.
2. Event Registration and Payment
Registration. Event registration is completed through our website or by contacting our team directly. By registering, you agree to provide accurate and complete information. Registration is not confirmed until payment has been received.
Payment. Event fees are listed on our website and are due at the time of registration or at the door, as indicated. We accept payment through Venmo (@kaizendojofinance) and Zelle ([email protected]). All payments are processed through these third-party platforms, and you agree to their respective terms of service when using them.
Refund Policy. All event fees are non-refundable unless an event is cancelled by Kaizen Dojo. In the event of cancellation by us, registered participants will receive a full refund or the option to transfer their registration to a future event. If you are unable to attend after registering, you may request a credit toward a future event at our discretion. Please contact us as soon as possible if your plans change.
3. Event Participation
Commitment to Full Attendance. Our events are designed as immersive, continuous experiences. Participants are expected to attend the entire duration of the event. Partial attendance, leaving and returning during programming, or early departure is not permitted, as the experience builds progressively throughout the weekend.
Code of Conduct. Participants are expected to treat all attendees, facilitators, and staff with respect. Disruptive, threatening, harassing, or otherwise inappropriate behavior will not be tolerated. We reserve the right to remove any participant whose behavior negatively impacts the experience of others, without refund.
Assumption of Risk. Our events may include physically, mentally, emotionally, and spiritually challenging activities. By registering and participating, you acknowledge that you voluntarily assume all risks associated with participation, including but not limited to physical injury, emotional distress, or property damage. You agree to inform us of any medical conditions, physical limitations, or other concerns that may affect your ability to participate safely.
4. Liability Waiver and Release
To the fullest extent permitted by law, you agree to release, hold harmless, and indemnify Kaizen Community, its officers, directors, facilitators, volunteers, agents, and employees from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your participation in any event or use of our services.
You acknowledge that this waiver applies to claims arising from negligence, and that you are voluntarily participating with full knowledge of the risks involved. This does not waive liability for gross negligence or willful misconduct.
5. Health and Safety
You represent that you are physically and mentally fit to participate in our events. If you have any medical condition, allergy, or limitation that could affect your participation or safety, you must disclose this information at the time of registration. We reserve the right to deny participation to any individual whose condition may pose a risk to themselves or others.
For events involving minors, parents or guardians must provide complete medical and emergency contact information at registration. Our facilitators are trained to handle emotional situations with care, but we are not medical professionals and do not provide medical services.
6. Intellectual Property
All content on our website, including text, graphics, logos, images, audio, video, and other materials, is the property of Kaizen Community or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from our website without our prior written consent.
The names "Kaizen Dojo," "Kaizen Community," "Kaizen Men's Weekend," "Young Men's Weekend," and associated logos and branding are the property of Kaizen Community. Unauthorized use is prohibited.
7. User Content and Media
By participating in our events, you grant Kaizen Community a non-exclusive, royalty-free, perpetual, and worldwide license to use photographs, videos, testimonials, and other media captured during events for promotional, educational, and community-building purposes, including on our website, social media, and marketing materials. If you do not wish to be photographed or recorded, please notify us in writing prior to the event.
8. SMS and Email Communications
By providing your contact information, you consent to receive SMS messages, emails, and other communications from Kaizen Dojo related to events, updates, and promotions. You may opt out of SMS messages at any time by replying STOP. You may unsubscribe from emails by clicking the unsubscribe link in any email. Standard message and data rates may apply. 9. Third-Party Services
Our website and services may integrate with or link to third-party platforms, including Venmo, Zelle, social media platforms, and other tools. We are not responsible for the availability, accuracy, content, or practices of third-party services. Your use of third-party services is governed by their respective terms and policies.
10. Disclaimer of Warranties
Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that our website will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
11. Limitation of Liability
To the maximum extent permitted by law, Kaizen Community, its officers, directors, facilitators, volunteers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, participation in events, or these Terms, regardless of the theory of liability. Our total aggregate liability shall not exceed the amount you paid for the specific event or service giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Kaizen Community and its officers, directors, facilitators, volunteers, agents, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your participation in events, your use of our services, or your violation of any rights of a third party.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising out of or related to these Terms or your use of our services shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in the County of Los Angeles, California, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
14. Modifications to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Your continued use of our services after any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
16. Entire Agreement
These Terms, together with our Privacy Policy and any event-specific waivers or agreements, constitute the entire agreement between you and Kaizen Community regarding your use of our services and participation in our events. These Terms supersede all prior agreements, representations, and understandings.
